From personal experience, I know that achieving an effective resolution regarding the return of a child to the country of habitual residence based on the Hague Convention on the Civil Aspects of International Child Abduction is very difficult. In the summer of 2023, my Son was kidnepping from me. As a Lawyer, I acknowledge that in some jurisdictions of the modern world, there are still not enough effective measures for the swift detection of children and the criminal prosecution of those who wrongfully take or retain children.
In many countries, due to budget constraints, employees of social services and law enforcement agencies lack sufficient expertise to address issues related to the return of children under the Hague Convention. Therefore, the establishment of a specialized foundation, whose employees are familiar with the application of international law and provide recommendations to social workers in cases of child return, is a justified necessity. Such a foundation would maintain regular contacts with central authorities and coordinate all necessary actions for the return of children, including police involvement.
